The foregoing is meant to be a general guide as to the symptoms of alcohol intoxication. The symptoms and level of resistance to intoxication will vary from person to person. In New Jersey please remember that it is the blood alcohol level as determined by either an alcotest machine or blood test is what determines intoxication (DUI DWI Drunk Driving) in the vast majority of cases.
Also remember that a person who operates a motor vehicle with a blood alcohol concentration (BAC) of 0.08% or above is considered to be driving under the influence in New Jersey. A person may also be found to be driving under the influence (DUI DWI Drunk Driving) through officer observation or other evidence.
Keep in mind that there is a difference in New Jersey between DUI DWI Drunk Driving at a level of .08 to less than .10, as opposed to a DUI DWI Drunk Driving with a reading of .10 and over. For a complete analysis of the penalties that apply CLICK THIS LINK.
