Certain crimes and offenders are ineligible for ISP:
Where defendant is serving a sentence for second degree unlawful possession of a hand or machine gun or other assault weapon
Where the defendant is serving time for a conviciton for a 1st degree crime.
Defendant has been released within the last 5 years for a prior 1st degree crime;
Where defendant is involved in organized crime
Any other mandated parole ineligibility imposed by statute or by court
No Early Release Act (NERA)
Must serve 85% of sentence before parole eligibility if committed: (COUNTS FOR ATTEMPT too)
